1. Charges to Your Billing Account.

1. General.

TrystDirectory.com bills you through an online account (hereinafter "Account") for use of the Service. You agree to pay TrystDirectory.com all charges at the prices then in effect for any use of the Service by you or other persons (including your agents) using your Account, and you authorize TrystDirectory.com to charge your chosen payment provider (your "Payment Method") for the Service. You agree to make payment using that selected Payment Method. TrystDirectory.com reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

2. Recurring Billing.

Most membership plans to the Service consist of an initial period, for which there is a one time charge, followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your membership has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. You also agree that your access can be limited if a recurring payment fails to go through.

3. Current Information Required.

YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION FOR YOUR BILLING ACCOUNT. YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR ACCOUNT CURRENT, COMPLETE AND ACCURATE (SUCH AS A CHANGE IN BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY TrystDirectory.com IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USER NAME OR PASSWORD. CHANGES TO SUCH INFORMATION CAN BE MADE AT ACCOUNT SETTINGS. IF YOU FAIL TO PROVIDE TrystDirectory.com ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT TrystDirectory.com MAY CONTINUE CHARGING YOU FOR ANY USE OF THE SERVICE UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINATED YOUR MEMBERSHIP FOR THE SERVICE (CONFIRMED BY YOU IN WRITING UPON REQUEST BY TrystDirectory.com).

4. Change in Amount Authorized.

If the amount to be charged to your Account varies from the amount you preauthorized (other than due to the imposition or change in the amount of state sales taxes), you have the right to receive, and TrystDirectory.com shall provide, notice of the amount to be charged and the date of the charge at least 10 days before the scheduled date of the transaction. Any agreement you have with your financial institution, credit card issuer or other provider of your chosen will govern your use of your Payment Method. You agree that TrystDirectory.com may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.

5. Auto-renewal.

Your TrystDirectory.com membership will be automatically extended for successive renewal periods of the same duration as the membership term originally selected, at the then-current non-promotional membership rate. You may change or resign your membership at any time. If you resign, you may use your membership until the end of your then-current membership term; your membership will not be renewed after your then-current term expires. However, you won't be eligible for a prorated refund of any portion of the membership fee paid for the then-current membership period.

6. Reaffirmation of Authorization.

Your non-termination or continued use of the Service reaffirms that TrystDirectory.com is authorized to charge your Payment Method. TrystDirectory.com may submit those charges for payment and you will be responsible for such charges. This does not waive TrystDirectory.com's right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially obtained your membership to the Service.

(h) Free Trials and Other Promotions.

Any free trial or other promotion that provides member level access to the Service must be used within the specified time of the trial. You must cancel your membership before the end of the trial period in order to avoid being charged a membership fee. If you cancel prior to the end of the trial period and are inadvertently charged for a subscription, please contact Customer Care to have the charges reversed.

2. Other Terms

The terms of your payment ("Payment Terms") will be based on your Payment Method and may be determined by agreements between you and your chosen provider of your chosen Payment Method. If TrystDirectory.com does not receive payment, you agree to pay all amounts due on your Account upon demand.

When you make payments to TrystDirectory.com, you agree to these Payment Terms. 

1. Making Purchases

   1. When you confirm a transaction on TrystDirectory.com, you agree to be bound by and pay for that transaction.

   2. Pay attention to the details of the transaction, because your total price may include taxes, fees, and shipping costs, which you are responsible for paying.

   3. Don't commit to a transaction unless you are ready to pay, because all sales are final.

   4. You may be presented with additional terms related to a specific purchase before you confirm the transaction (such as shipping terms for tangible goods). Those additional terms will also govern that transaction.

   5. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH TrystDirectory.com.

2. Payment Sources

   1. When you provide a Payment Method to us, you confirm that you are permitted to use that Payment Method. You also authorize us to collect and store it, along with other related transaction information.

   2. When you make a payment, you authorize us (and our designated payment processor) to charge the full amount to the Payment Method you designate for the transaction.

   3. If you pay by credit or debit card we may obtain a pre-approval from the issuer of the card for an amount up to the amount of the purchase. We will bill your card at the time of purchase or shortly thereafter. If you cancel a transaction before completion, that pre-approval may result in your funds not otherwise being immediately available.

   4. If you pay by debit card and your payment results in an overdraft or other fee from your bank, you alone are responsible for that fee.

   5. If your Payment Method is no longer viable, we may limit your access to TrystDirectory.com. However, you will still be liable for the amount charged.

3. Actions We May Take

As part of our effort to keep TrystDirectory.com safe, we may take certain actions to reduce liability for users and us.

1. We may make any inquiries that we consider necessary, either directly or through third parties, concerning your identity and creditworthiness.

2. We may cancel any transaction if we believe the transaction violates these Payments Terms or the Terms of Use, or we believe doing so may prevent financial loss.

3. We may place a delay on a payment for a period of time, limit payment sources for a transaction, limit your ability to make a payment or deactivate your account if we believe doing so may prevent financial loss.

4. We may contact your Payment Method issuer, law enforcement, or impacted third parties (including other users) and share details of any payments you are associated with if we believe doing so may prevent financial loss or a violation of law.

5. If you purchase advertising, and your payment method fails or your account is past due, we may take steps to collect past due amounts using other collection mechanisms. You agree to pay all expenses associated with such collection, including reasonable attorneys' fees. Interest will accrue on any past due amounts at the rate of the lesser of 1% per month or the lawful maximum.

4. Disputes and Reversals

1. If you believe that an unauthorized or otherwise problematic transaction has taken place under your account, you agree to notify us immediately, so that we may take action to prevent financial loss.

2. To the fullest extent permitted by law, you waive all claims against us related to payments unless you submit the claim to us within 30 days after the charge.

3. You are responsible for and agree to reimburse us for all reversals, charge-backs, claims, fees, fines, penalties and other liability incurred by us (including costs and related expenses) that were caused by or arising out of payments that you authorized or accepted.

4. If you enter into a transaction with a third party and have a dispute over the goods or services you purchased we have no liability for such goods or services. Our only involvement with regard to such transaction is as a payment agent.

5. We may intervene in disputes between users concerning payments but have no obligation to do so.

6. Your only remedy for a technical failure or interruption of service is to request that your transaction be completed at a later time.

5. Special Provisions Applicable to Advertisers

   1. When you purchase advertising on or through TrystDirectory.com, you agree to pay all amounts specified in the order, along with any applicable taxes.

   2. You are responsible for maintaining the security of your advertising account, and you understand that you will be charged for any orders placed on or through your advertising account.

   3. You can cancel an advertising order at any time through our online portal, but your ads may run for several days after you notify us, and you are still responsible for paying for those ads.

   4. It is your responsibility to remit any taxes that apply to your transactions. You agree to indemnify and hold us harmless from and against any claim arising out of your failure to do so.

6. Notices and Amendments to These Payments Terms

   1. We may provide notices to you by sending them to an email address or street address that you previously provided to us. Email notices shall be considered received by you within 24 hours of the time sent; notices by mail shall be considered received within three business days of the time sent.

   2. Except as otherwise stated, you must send notices to us relating to payments and these Payment Terms by postal mail to: TrystDirectory.com, include address.

   3. The Payment Terms in place at the time you confirm a transaction will govern that transaction.

   4. We may change these Payment Terms without notice.

7. Other

   1. All of the commitments you make in the TrystDirectory.com Terms of Use apply to payments to TrystDirectory.com. In the event of any conflict between these Payments Terms and the TrystDirectory.com Terms of Use, the Payments Terms shall prevail.

   2. If you are under the age of 18, you may make not make any purchases.

   3. Some countries may restrict or prohibit your ability to make payments to TrystDirectory.com. Nothing in these Payments Terms should be read to override or circumvent any such foreign laws.
